# Terms of Use **Nutrition Tracker - MyFitMate** *Effective Date: 28 December 2025* *Last Updated: 26 May 2026* ## 1. Introduction Welcome to **MyFitMate** (the "App"). These Terms of Use ("Terms") are an agreement between **Yury Tomachinskiy** ("we", "our", or "MyFitMate") and you. By using the App or any related service we provide (the "Services"), you agree to these Terms. If you do not agree, do not use the Services. MyFitMate is designed to be privacy-focused. We do not collect personal account data, do not track users for advertising, and do not require Apple Sign In, email sign-in, names, phone numbers, or personal profiles to use the App. ## 2. Eligibility 1. You must be at least **16 years old** to use the Services. 2. If you are aged 16-17, you should review these Terms with a parent or legal guardian. 3. The App is not intended to diagnose, treat, cure, or prevent any medical condition, including eating disorders. 4. If you have a medical condition or concerns about nutrition, eating, exercise, or body weight, use the App only with appropriate professional guidance. ## 3. Privacy-First Design 1. **No personal account data or ad tracking.** MyFitMate does not collect personal account data and does not track users for advertising. We do not require you to create a personal account or provide Apple Sign In, email, name, phone number, date of birth, address, government ID, contacts, precise location, advertising identifiers, or a personal profile. 2. **No Apple Sign In.** The App does not use Apple Sign In for identity or account creation. 3. **Limited feature processing.** The App only processes the limited data needed to provide its features, protect the Services, and respond to requests you choose to make. 4. **Temporary uploads.** If you upload a meal image for analysis, the image is used temporarily to generate the requested result and is deleted from our upload storage within **10 minutes** after upload. 5. **Local data.** Saved meals, photos, preferences, and nutrition history may be stored locally on your device or in your own iCloud storage depending on your device settings. You are responsible for managing local and iCloud data on your device. 6. **No sale of data.** We do not sell user data and we do not use third-party advertising SDKs. ## 4. App Integrity, Abuse Prevention, and Security We may use Apple App Attest, DeviceCheck, short-lived challenges, cryptographic assertions, rate limits, or similar safeguards to verify that requests come from a genuine copy of the App and to prevent abuse. These checks are not Apple Sign In and are not used to create a personal identity profile. If security checks fail or appear suspicious, we may deny, delay, or limit access to protected actions such as image upload or AI analysis. ## 5. Subscriptions and Billing 1. MyFitMate may offer paid access through Apple In-App Purchase. 2. Payment processing is handled by Apple. We do not store your full payment card details. 3. Subscriptions auto-renew unless you turn off auto-renew at least 24 hours before the end of the current period. 4. You can manage or cancel subscriptions in **Settings > Apple ID > Subscriptions** on your Apple device. 5. Refund requests must be made through Apple under Apple's refund policies. ## 6. Uploaded Content and AI Analysis 1. You may submit meal photos or meal descriptions to request nutrition estimates. 2. Uploaded meal images are temporary and are deleted from our upload storage within **10 minutes** after upload. 3. We use submitted meal images or text only to provide the requested analysis, protect the Services, and comply with these Terms. 4. You must not upload illegal, harmful, abusive, pornographic, hateful, harassing, infringing, or dangerous content. 5. We may reject, moderate, or block uploads that appear abusive, illegal, unsafe, or inconsistent with the App's purpose. ## 7. Acceptable Use You must not: - Scrape, harvest, or misuse the Services or any database; - Reverse-engineer, tamper with, or interfere with the App or security checks; - Bypass App Attest, DeviceCheck, upload protections, subscription checks, rate limits, or access controls; - Forge, replay, automate, or misuse challenges, attestations, assertions, tokens, or upload requests; - Upload malware or attempt unauthorized access; - Use the Services to harass, harm, or exploit any person; - Use the Services for commercial meal-analysis services without our written consent. ## 8. Health and AI Disclaimers 1. MyFitMate provides approximate nutrition and calorie estimates for informational purposes only. 2. The Services do not provide medical advice and are not a substitute for a doctor, registered dietitian, or other qualified professional. 3. AI results may be wrong. The App may misidentify foods, portion sizes, ingredients, calories, or nutrients. 4. You should review and correct AI-generated entries before relying on them. 5. Do not use the Services for emergencies or urgent health decisions. ## 9. Intellectual Property Except for content you submit, the App, Services, code, design, text, logos, and related materials are owned by or licensed to MyFitMate. You may use the Services only as allowed by these Terms. Some nutrition information may be sourced from **OpenFoodFacts** under the Open Database License (ODbL): https://opendatacommons.org/licenses/odbl/1.0/ ## 10. Ending Use You may stop using the App at any time. You can delete local App data using your device settings or the App's controls where available. Because MyFitMate does not require personal account registration, we may not be able to identify or recover data stored only on your device or in your iCloud account. ## 11. Limitation of Liability To the fullest extent permitted by law, MyFitMate and its affiliates are not liable for any loss or damage arising from your access to, use of, or inability to use the Services. This includes, without limitation, loss or corruption of data, inaccurate nutrition estimates, health or fitness decisions made using the App, failed uploads, rejected security checks, subscription issues handled by Apple, or any indirect, incidental, special, consequential, exemplary, or punitive damages. Nothing in these Terms excludes or limits liability that cannot be excluded by law. Your statutory consumer rights remain unaffected. ## 12. Changes to These Terms We may update these Terms from time to time. If changes are material, we will provide notice in the App or by another reasonable method. Continued use after the effective date means you accept the updated Terms. ## 13. Governing Law These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws in your country of residence apply. ## 14. Contact Questions?
